This Privacy Policy (the “Privacy Policy”) is intended to explain what types of information we at FlashingBlinkyLights.com, Inc. ("FlashingBlinkyLights") collect about you, and how we use and share that information. One section of this privacy policy also addresses what happens with information we collect on our pages on social media sites, such as Facebook, Instagram, Pinterest, Twitter, and YouTube ("Social Media Pages"). This Privacy Policy applies only to the information collected online at www.flashingblinkylights.com (the "Site") and the Social Media Pages, mobile applications, forums, blogs, and other online or offline offerings (together with any and all future online and offline offerings operated by or on behalf of FlashingBlinkyLights, the “Services”), as well as information collected by us offline. This Privacy Policy is intended to meet global privacy requirements, including those in North America, the European Union, Asia-Pacific regions, and other jurisdictions. This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our Services.

  1. Collection of Personal Information. FlashingBlinkyLights may ask you to provide personal information when you establish or update an Account on the Site, sign up to receive emails from FlashingBlinkyLights or other marketing materials, make a purchase, contact customer support, create or update your wish list, send items to a friend, view your order history, participate in contests and surveys, submit a career profile, or contact us. Categories of personal information collected online include name, billing and shipping address information, email address, telephone number, mobile number, credit card information, resume information, and any other information you choose to provide us “Personal Information” as used in this Privacy Policy is considered to be any information relating to an identified or identifiable natural person (“Individual”). We do not consider Personal Information to include information that has been aggregated or anonymized so that it cannot be used to identify a specific individual.

  2. Collection of Navigational Information. When you visit our Site, we and third parties that provide functionality on the Site may engage, receive and record information about how you use and interact with the Site. This information is referred to in this Privacy Policy as "Navigational Information" and allows us to see which areas of the Site are most visited and helps us better understand our visitors' experiences at the Site.

    FlashingBlinkyLights and third-party service providers who provide services to our Site collect Navigational Information from technology such as Cookies and Web Beacons. Cookies are small text files that help us to personalize the content of theSite. Web Beacons are electronic files used to track your navigation on a website or collection of sites, the completion of transactions, submittal of applications and browsing behavior.     Again, you must separately opt out on each device. Advertisements on Third-Party websites that contain the AdChoices link and that link to this Privacy Policy may have been directed to you based on anonymous, non-Personal Information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt out of the advertising partners’ use of this information for interest-based advertising purposes. As stated above, if you delete your cookies, use a different browser, or buy a new computer, tablet or mobile device, you will need to renew your opt-out choice(s).

  3. Collection of Information from Social Media Pages. Personal Information may be collected directly by us through our Social Media Pages and may also be collected by the social media sites hosting our Social Media Pages (each, a "Social Media Site"). This Privacy Policy does not cover Personal Information collected by any Social Media Site or the privacy and security practices of any Social Media Site. Please review privacy policies and terms of service on the applicable Social Media Site, if you have any questions about their privacy or security practices. Social Media Sites may provide aggregate information and analysis to us about visitors' use of our Social Media Pages. This allows us to better understand and analyze our user growth, general demographic information about the users of our Social Media Pages, and interaction with content on our Social Media Pages. Overall, this information may be used to help us understand the types of visitors and users of our Social Media Pages and use of the content. Our Website includes social media features such as the Facebook “Like” button. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

  4. Use of Your Information. FlashingBlinkyLights uses your Information to: deliver products that you have ordered; contact you or the product recipient(s) in the event of order delay or difficulty; deliver information through the various communication channels you have provided to us about our products or the Site, including adding you to our email list or to our customer phone and mail marketing list when you register for an account or make a purchase; send information about events, surveys, promotions and possibly contests to you; send text messages, with your consent, about events, surveys, promotions and other offers to you; tailor your experience on the Site to your interests; develop and improve our products, services, and the Site, including fraud prevention; and respond to your inquiries.

    If you have set up an Account at the Site, you may save Personal Information in that Account, and we will access this Personal Information to make your shopping quicker and easier. We require you to create and/or access your Account to use various features of the Site, such as accessing your order history and creating a wish list.

    With respect to emails, we will use your Personal Information to send you exclusive information about special offers, media events, new products and much more. If you complete a transaction on the Site or in person at one of our locations (i.e., make a purchase for monetary or non-monetary value of any kind), or create an account on the Site, and provide us with your email address, you will automatically be opted into our email marketing list. If at any time you would like to stop future delivery of emails from us, please follow the removal instructions located at the end of each email communication. We will process your request within a reasonable time after receipt. If you abandon your shopping cart (e.g., leave the Site, close the browser window on your desktop computer, mobile device or tablet, etc.) after providing us with your email address during the checkout process, you will automatically be opted into shopping cart abandonment emails hosted by a Third-Party Vendor doing business with us (“Cart Abandonment Emails”). If at any time you would like to stop future delivery of Cart Abandonment Emails, please follow the removal instructions located at the end of each email communication. Such requests will be processed within a reasonable time after receipt. Please note that you will be automatically re-opted into Cart Abandonment Emails any time you abandon your shopping cart whetheror not you complete a transaction on the Site. Notwithstanding any of the foregoing, you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding FlashingBlinkyLights and our Services and you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms and Conditions or this Privacy Policy). We use the Personal Information collected on our Social Media Pages to send communications regarding our products, services, and promotions; to respond to your inquiries; to conduct surveys, sweepstakes or contests; to analyze your activity on our Social Media Pages and to develop our products and services.

  5. Posting on the Site. You may post reviews of your purchases on FlashingBlinkyLights’s Site. You should be aware that, when you disclose information about yourself in on FlashingBlinkyLights’s Site, the Site will collect the information you provide in such submissions, including any Personal Information. If you choose to submit content to any public area of the Site, such content will be considered “public” and will not be subject to the privacy protections set forth herein.

  6. Registration for Sweepstakes or Contests. Occasionally, FlashingBlinkyLights may run sweepstakes and contests. We ask those who enter in the sweepstakes or contests to provide contact information (e.g., an e-mail address). If you participate in a sweepstakes or contest, your contact information may be used to reach you about the sweepstakes or contest, and for other promotional, marketing and business purposes. All sweepstakes/contests entry forms will provide a way for participants to opt-out of any communications that are not related to awarding prizes.

  7. Automatic Data Collection. Our servers automatically record certain information about how Individuals use our Services (collectively, “Event Data”). Event Data may include information such as an Individual’s Internet Protocol (IP) address, cookie identifiers, MAC address, IMEI, Advertiser ID, and other device identifiers that are automatically assigned to your computer or device when you access the Internet, operating system, browser type and language, hardware type, the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, search terms, the links on our Services that a User clicked on and other statistics. We use Event Data to administer the Services and we analyze (and may engage third parties to analyze) Event Data to improve, customize and enhance our Services by expanding their features and functionality and tailoring them to Individuals’ needs and preferences. We may use a person’s IP address to generate aggregate, non-identifying information about how our Services are used.

  8. Location Information. We may collect and store information about your location by converting your IP address into a rough geo-location. We may use location information to improve and personalize our Services for you. If you do not want us to collect location information, you may disable that feature on your mobile device.

  9. Information Submitted via Services. You agree that FlashingBlinkyLights is free to use the content of any communications submitted by you via the Services, including any ideas, inventions, concepts, techniques, or know-how disclosed therein, for any purpose including developing, manufacturing, and/or marketing goods or Services. FlashingBlinkyLights will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless:

    (b) we first send notice to you that the materials or other information you submit to a particular part of a Service will be published or otherwise used with your name on it; or

For example, if you access our Services through a Third-Party application, such as an App Store or on a Social Media Site, we may collect information about you from that Third-Party application that you have made public via your privacy settings. Information we collect through App Stores or accounts made on a Social Media Site may include your name, your Social Media Site user identification number, your Social Media Site user name, location, sex, birth date, email, profile picture, and your contacts on such Social Media Sites. This supplemental information allows us to verify information that you have provided to FlashingBlinkyLights and to enhance our ability to provide you with information about our business, products, and Services.

    Notwithstanding the foregoing, we may anonymize and aggregate data collected through the Site and use it for any purpose. Such information does not identify you individually.

  11. Information Shared with Vendors and Service Providers. We may use third party vendors to assist us with the Site and our e-commerce business (“Third-Party Vendors”). Some examples of the assistance that may be provided by third party service providers are: monitoring and analyzing Site activity, operations and marketing assistance, hosting the Site, assisting us with our Social Media Pages, processing orders, running promotions and events and surveys, maintaining our database, processing employment applications, providing fraud prevention services and administering and monitoring emails. We will share your Information with these Third-Party Vendors only as necessary for them to perform their functions and to the extent permitted by law.   12. Parents and Affiliates. We may share your Information with any of our parent companies, subsidiaries, joint ventures, or other companies under common control with us.

  13. Email Referrals. When you send an email from the Site to a friend, we will send the recipient of the email your email address, message, and your selected outfit or item(s). We may include an opportunity for the recipient to sign up to receive promotional materials from us. 

  14. Business Transactions. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.   19. Updating Your Personal Information. We prefer to keep your Personal Information accurate and up-to-date. To do this, we provide you with the opportunity to update or modify your Personal Information by logging in to your Account.

  20. Children. We do not knowingly collect Personal Information from children under the age of 13 through the Site. If you are under 13, please do not give us any Personal Information.
